Transcript of the
Will of Caleb Whiting
In the name of God, Amen.
I, Caleb Whiting of Douglas in the County of Worcester and Commonwealth of Massachusetts, yeoman, considering the uncertainty of this mortal life, and visioning myself near the end of the same, yet being of sound and perfect mind and memory, (Blessed be Almighty God for the same) do make and publish this my last will and testament, in the manner and form following, viz.
1. I direct and order that all my just debts and funeral charges shall be paid by my Executor hereafter named.
2. I give and bequeath unto my beloved wife, viz Hannah Whiting, a descent maintenance out of my Estate during her life, or, if she shall at any time chose it, the use and improvements of one third part of all my real estate. I also give and bequeath to the above mentioned Hannah Whiting my beloved wife, one third part of all my indoor moveables to be at her disposal forever, also the improvement of the remaining two thirds of my indoor moveables, together with one cow and two sheep, during her life.
3. I give and bequeath to my eldest daughter viz Sarah and her heirs, two dollars - also to the heirs of my son John Whiting, deceased, two dollars - also to my son Abner Whiting and his heirs, two dollars - also to my son Timothy Whiting and his heirs, two dollars - also to my daughter Hannah Fairbank and her heirs, I give and bequeath two thirds of my indoor moveables together with a cow and two sheep to be delivered to her at the decease of my beloved wife Hannah Whiting.
4. It is my will that the above mentioned legacies to my eldest daughter and to my sons or their heirs be paid in one year after my decease.
5. It is my will, that, at my decease, my wearing apparel may be equally divided among my sons that shall be then living.
6. It is my will that my pew, in the Congregational meetinghouse in this town, remain forever, for the use and improvement of all my heirs or descendents who may reside in this town.
7. All the residue and remainder of my estate both real and personal excepting what is required to enable my executor hereafter named to pay the above mentioned debts and legacies and to give my beloved wife Hannah Whiting a comfortable maintenance and to a decent burial. I give, bequeath and devise to the children of my son David Whiting, to be equally divided amongst them or their heirs at the decease of their father, David Whiting.
8. It is my will that the use and enforcement of the above mentioned legacy to the children of my son David Whiting be appropriated during his life to the maintenance and support of his family.
9. I do appoint and ordain my son-in-law, Capt. Joshua Fairbank, the sole executor of this my last will and testament, and do herby revoke all wills heretofore made by me. In testimony whereof, I do hereunto set my hand and seal to this my last will and testament, this twentyfourth day of January, in the year of our Lord one thousand eight hundred and sixteen.
